1. INTRODUCTION
1.1 MTN Nigeria Communications Plc (“MTN Nigeria”) offers a Fibre Optic Network Terminal (“ONT”) to its customers on a free-to-use, but subscription-fee basis, subject to these Terms and Conditions (T & Cs).
1.2 By accepting, installing, or using MTN’s ONT service, the Customer acknowledges that it has read, understood, and agrees to be bound by these terms and conditions, as may be amended by MTN from time to time.
2. ELIGIBILITY
2.1 This offer is available to new and existing MTN Nigeria customers.
2.2 Customers must be at least 18 years old and have a valid means of Nigerian identification.
2.3 MTN Nigeria reserves the right to verify customer eligibility at any time and may request additional information or documentation.
3. PROVISION, OWNERSHIP AND RETURN 
3.1 MTN Nigeria will provide the Fibre ONT services to eligible customers.
3.2 The ONT shall remain the sole property of MTN Nigeria, and is provided to the Customer solely for the purpose of accessing MTN FibreX services.
3.3 The Customer shall make the ONT available for retrieval upon the following:
3.2.1 Termination or disconnection of the FibreX service;
3.2.2 Prolonged Inactivity (without revenue and/or data traffic/no usage) of the associated FibreX service for a continuous period of six (6) months, provided MTN has given prior notice to the Customer.
- Where the Customer requests relocation of the FibreX service to another address within MTN’s service coverage area, MTN may facilitate such relocation subject to technical feasibility and the Customer’s compliance with any applicable requirements communicated by MTN.
- Any request to reposition the ONT within the same building after installation shall attract a service fee as determined and communicated by MTN from time to time.
4. INSTALLATION AND ACTIVATION
4.1 At the point of purchase, the Customer is required to select a preferred installation date and available time slot.
4.2 MTN shall use reasonable efforts to complete installation of the ONT within fourteen (14) working days following successful order confirmation and payment. Installation and activation, however, is subject to the following:
- operational feasibility;
- availability of installation personnel;
- fibre availability,
- site readiness,
- safety conditions,
- weather conditions,
- regulatory or third-party constraints,
- or access to premises.
4.3 Customers may request to reschedule their installation appointment by providing prior notice (minimum of 48 hours) through MTN’s designated support channels. Any revised installation date shall be subject to availability.
4.4 Customers shall ensure unrestricted access to the premises at the scheduled installation date and time. Failure to provide access may result in rescheduling and additional delays.
4.5 Customers are responsible for ensuring that the installation environment is suitable for installation and operation of the ONT, including the availability of electrical power, a secure mounting location and any internal wiring reasonably required for service delivery.
4.6 Service activation shall be completed upon successful installation and testing of the ONT device, provided all required conditions are met.
5. USAGE
5.1 The ONT may only be used in connection with MTN FibreX services and shall not be connected to, integrated with, or used for any third-party network or service without MTN’s prior written consent.
5.2 Customers’ use of the ONT shall comply with the Acceptable Use Policy in clause 6 below.
5.3 Customers shall not tamper with, modify, or reverse-engineer the ONT.
6. ACCEPTABLE USE POLICY
Customers must use the ONT and MTN Nigeria’s FibreX services in accordance with the acceptable use policy as detailed below:
6.1. Prohibited Activities
Customers must not use the ONT or MTN FibreX services for:
6.1.1 Illegal Activities: Any illegal or unlawful activities, including but not limited to, hacking, cracking, or distributing unauthorized software.
6.1.2 Harmful or Offensive Content: Transmitting, storing, publishing or disseminating any unlawful, harmful, abusive, fraudulent, defamatory or otherwise prohibited content, including child sexual abuse material or content prohibited under applicable law.
6.1.3 Spamming: Sending unsolicited emails, messages, or spamming in any form.
6.1.4 Network Abuse: Interfering with or disrupting MTN Nigeria’s network or services, including but not limited to, denial-of-service attacks or network congestion.
6.1.5 Copyright Infringement: Infringing on copyrights, trademarks, or intellectual property rights of any person or entity
6.2. Permitted Activities
The Customer may use the ONT services for:
6.2.1 Personal, non-commercial use, such as browsing, emailing, gaming and streaming.
6.2.2 Business use, such as remote work, online meetings, and cloud computing.
6.2.3 Online education, research, and learning activities.
7. CUSTOMER’S RESPONSIBILITIES
The Customer is responsible for:
7.1. Ensuring the security of their devices, credentials, and data.
7.2. Supervising usage of the ONT by minors, vulnerable individuals or third parties.
7.3. Compliance with all applicable laws, regulations, and MTN Nigeria’s policies.
7.4. Exercising reasonable care in the custody, protection and use of the ONT and take all reasonable measures to prevent its theft, loss, damage, misuse or unauthorized access.
8. CONSEQUENCES OF NON-COMPLIANCE
Customer’s failure to comply with this T &C may result in:
8.1 A warning from MTN Nigeria to cease non-compliant activities.
8.2 Suspension of MTN FibreX services.
8.3 Termination of MTN FibreX services and ONT usage.
8.4 Reporting the matter to the relevant regulatory, law enforcement or governmental authorities and/or commencement of appropriate legal proceedings.
9. TERMINATION BY CUSTOMER
9.1 If the customer terminates their MTN FibreX service, they must make the ONT available for retrieval within 14 days after confirmation of service termination.
9.2 Failure to return or make the ONT available for retrieval within fourteen (14) days of notice from MTN may result in the Customer being charged the applicable replacement fee communicated by MTN.
10. WARRANTY
10.1 During the applicable warranty period, MTN may repair or replace an ONT that becomes defective due to manufacturing defects or faults not attributable to the Customer.
10.2 MTN shall not be responsible for defects, failures or damage resulting from misuse, negligence, unauthorized modification, improper handling, accidental damage, power surges or other external causes.
11. INDEMNITY AND LIMITATION OF LIABILITY
11.1 The Customer shall indemnify and hold harmless MTN Nigeria against any claims, damages, or liabilities arising from:
- misuse of the ONT;
- breach of these Terms; or
- violation of applicable laws
11.2 MTN Nigeria shall not be liable for any indirect, incidental, special, punitive or consequential loss or damage, including loss of profits, revenue, goodwill, data or business opportunities arising from or in connection with the ONT or FibreX service.
12. MAINTENANCE AND UPGRADES
12.1 MTN Nigeria is responsible for maintaining and repairing the ONT.
12.2 Customers shall provide access to the ONT for maintenance and repair purposes.
12.3 MTN reserves the right to upgrade or replace the ONT at any time.
12.4 Where MTN upgrades or replaces the ONT, the Customer shall reasonably cooperate with MTN and shall not unreasonably refuse the installation of such replacement equipment where required for continued service delivery.
13. DAMAGE OR LOSS
13.1 The Customer assumes responsibility for the ONT from the date of installation and shall remain.
13.2 The Customer shall promptly notify MTN of any loss, theft, destruction or damage to the ONT.
13.3 The Customer shall be liable for loss, theft or damage to the ONT (other than fair wear and tear or damage resulting from defects not caused by the Customer).
13.4 In the event of loss, theft or irreparable damage to the ONT, MTN may charge the Customer a replacement fee determined by MTN acting reasonably and communicated to the Customer.
14. FORCE MAJEURE
Neither Party shall be liable for any failure or delay in performing its obligations under these Terms and Conditions where such failure or delay results from circumstances beyond its reasonable control, including acts of God, natural disasters, civil unrest, strikes, regulatory actions, network failures, utility outages or similar events.
15. DATA PROTECTION AND PRIVACY
MTN shall, where applicable, process personal data in compliance applicable Data Protection Laws in Nigeria and MTN’s privacy policy.
16. VARIATION
MTN reserves the right to amend these Terms and Conditions from time to time. Any material amendment shall be communicated to Customers through appropriate channels, including SMS, email, the MTN website, customer care platforms or any other channel determined by MTN.
17. GOVERNING LAW
These terms and conditions are governed by Nigerian law.
18. DISPUTE RESOLUTION
18.1 Any disputes arising from these terms and conditions shall be resolved first through formal negotiations between the Customer and MTN Nigeria, failing which the dispute shall be referred to mediation and if the dispute still remains unresolved, the dispute shall be referred to a Nigerian court of competent jurisdiction.
19. ADDITIONAL TERMS
19.1 Customers must agree to MTN Nigeria’s standard Fibre broadband terms and conditions.
19.2 The free-to-use ONT offer is subject to availability and may be withdrawn at any time.
19.3 MTN Nigeria reserves the right to charge a security deposit for the ONT, refundable upon return.

21. ACCEPTANCE
