1. Introduction
1.1 MTN Nigeria Communications Plc (“MTN Nigeria”) is offering a Fibre Optic Network Terminal (“ONT”) to its customers on a free-to-use basis, subject to these terms and conditions.
1.2 By accepting the free ONT, customers acknowledge that they have read, understood, and agreed to be bound by these terms and conditions.
2. Eligibility
2.1 This offer is available to new and existing MTN Nigeria customers who subscribe to minimum of 50Mbps of our fibre broadband services.
2.2 Customers must be at least 18 years old and have a valid Nigerian identity document.
2.3 MTN Nigeria reserves the right to verify customer eligibility and may request additional information or documentation.
3. Free Fibre ONT
3.1 MTN Nigeria will provide a Fibre Optic Network Terminal (“ONT”) to eligible customers at no upfront cost.
3.2 The ONT remains the property of MTN Nigeria, and customers must return it upon the following:
3.2.1: Termination of their fibre broadband service.
3.2.2: Relocation from current location
3.2.3: Inactivity (without revenue and/or data traffic) over a period of six months
4. Usage
4.1 The ONT is to be used only for MTN’s Fibre services
4.2 Customers must use the ONT in accordance with MTN Nigeria’s acceptable use policy. See Clause 5 below for details on Acceptable Use Policy.
4.3 Customers must not tamper with, modify, or reverse-engineer the ONT.
5. Acceptable Use Policy
Customers must use the ONT and MTN Nigeria’s fibre broadband services in accordance with this acceptable use policy.
Prohibited Activities
Customers must not use the ONT or fibre broadband services for:
1. Illegal Activities: Any illegal or unlawful activities, including but not limited to, hacking, cracking, or distributing unauthorized software.
2. Harmful or Offensive Content: Transmitting, storing, or publishing harmful or offensive content, including but not limited to, child pornography, hate speech, or discriminatory content.
3. Spamming: Sending unsolicited emails, messages, or spamming in any form.
4. Network Abuse: Interfering with or disrupting MTN Nigeria’s network or services, including but not limited to, denial-of-service attacks or network congestion.
5. Copyright Infringement: Infringing on copyrights, trademarks, or intellectual property rights of others.
Permitted Activities
Customers may use the ONT and fibre broadband services for:
1. Personal Use: Personal, non-commercial use, such as browsing, emailing, and streaming.
2. Business Use: Business use, such as remote work, online meetings, and cloud computing.
3. Online Education: Online education, research, and learning activities.
Responsibilities
Customers are responsible for:
1. Security: Ensuring the security of their devices, passwords, and data.
2. Supervision: Supervising children and vulnerable individuals when using the ONT and fibre broadband services.
3. Compliance: Complying with all applicable laws, regulations, and MTN Nigeria’s policies.
Consequences of Non-Compliance
Failure to comply with this acceptable use policy may result in:
1. Warning: A warning from MTN Nigeria to cease non-compliant activities.
2. Suspension: Suspension of fibre broadband services.
3. Termination: Termination of fibre broadband services and ONT usage.
4. Legal Action: Legal action, including but not limited to, damages and fines.
6. Warranty
5.1 MTN Nigeria warrants the ONT against manufacturing defects for a period of 12 months from installation.
5.2 The warranty does not cover damage caused by misuse, neglect, or external factors.
7. Maintenance
7.1 MTN Nigeria is responsible for maintaining and repairing the ONT.
7.2 Customers must provide access to the ONT for maintenance and repair purposes.
8. Upgrades
8.1 MTN Nigeria reserves the right to upgrade or replace the ONT at any time.
8.2 Customers must accept and install upgrades or replacements provided by MTN Nigeria.
9. Termination
9.1 If the customer terminates their fibre broadband service, they must make the ONT available for retrieval within 14 days after confirmation of service termination.
9.2 Failure to return or make the ONT available for retrieval may result in a charge of ₦30,000.
10. Damage or Loss
10.1 Customers are liable for any damage or loss to the ONT after due assessment.
10.2 Customers must pay a replacement fee of ₦30,000 for any damaged or lost ONT, except for damages or losses under force majeure circumstances.
11. Acceptance
11.1 By using the ONT, customers acknowledge acceptance of these terms and conditions.
12. Variation
12.1 MTN Nigeria reserves the right to modify or withdraw this offer at any time.
13. Governing Law
13.1 These terms and conditions are governed by Nigerian law.
14. Dispute Resolution
14.1 Any disputes arising from these terms and conditions will be resolved through arbitration in accordance with Nigerian law.
15. Additional Terms
15.1 Customers must agree to MTN Nigeria’s standard fibre broadband terms and conditions.
15.2 The free ONT offer is subject to availability and may be withdrawn at any time.
15.3 MTN Nigeria reserves the right to charge a security deposit for the ONT, refundable upon return.
